Terms of Use

These terms are the agreement between you and SafePlate for using our app and website. By creating an account or using SafePlate you accept them. Please read section 2 carefully — it explains what our dish flags can and cannot tell you.
SafePlate is not medical advice and is not a guarantee. Flags are built from ingredients restaurants publish. Recipes change and kitchens share equipment. If you have a severe allergy or risk of anaphylaxis, always tell your server and confirm with the kitchen before you order, and carry your prescribed medication.
1. What SafePlate is
SafePlate is an information tool. Guests tell us their allergens and diets; participating restaurants publish their dishes and ingredients; we compare the two and mark each dish Safe, Caution or Do Not Order, and each venue with a match badge. We do not cook food, take orders, handle payments, or employ restaurant staff, and we are not a party to your visit.
2. How flags work and their limits
Safe means nothing in the published ingredients conflicts with your profile. Caution means the ingredient list is incomplete, says "may contain", or a shared-kitchen risk exists. Do Not Order means a published ingredient conflicts directly with an allergen or diet in your profile. In a party, the strictest result wins for the whole table.
Flags are only as good as the data a restaurant enters and the profile you keep. They cannot detect cross-contamination in the kitchen, supplier substitutions, off-menu specials, or a recipe changed that morning. Treat every flag as a starting point for a conversation with your server, never a substitute for it.
3. Your account and profile
You must be 13 or older to hold an account and provide accurate information. Keep your allergens and diets up to date — outdated profiles produce misleading flags. You are responsible for activity under your account and for keeping your credentials secure. One person per account; do not share logins.
4. Parties and invite codes
Joining a party shares your display name and your allergy and diet chips with the other members. Only share invite codes with people you trust, and do not use another person's dietary information without their permission. Hosts may end a party at any time; you may leave at any time.
5. Reviews and content you post
Reviews must reflect a genuine experience. Do not post false or misleading claims, content about a venue you have not visited, paid or incentivised reviews, personal attacks, or anyone's private information. We may remove content that breaks these rules or the law.
You keep ownership of what you post and grant SafePlate a worldwide, royalty-free licence to host, display and distribute it within the service. Restaurants may see your rating, comment, and display name. If we invite you to also review a venue on Google or Yelp, those sites have their own terms.
6. Restaurant obligations
If you manage a venue on SafePlate you confirm you are authorised to act for it, and you agree to keep dishes, ingredients, allergen information, address and photos accurate and current — including updating SafePlate promptly when a recipe or supplier changes. You are responsible for complying with the food-safety and allergen-labelling laws that apply to you; SafePlate does not replace legal allergen disclosure at the point of sale.
You must own or have the right to use every photo you upload, and photos must depict your own dishes and premises. Do not upload someone else's imagery. Analytics we provide are aggregated estimates for your own venue and must not be used to identify individual guests. We may remove listings or content that is inaccurate, misleading, or unsafe.
7. AI ingredient assistance
Our AI features suggest ingredients, allergens and diet tags from text you write or a photo of an ingredient list. Suggestions are drafts and can be wrong or incomplete. Nothing is saved to your menu until you review and accept it, and you remain responsible for the accuracy of everything you publish.
8. Acceptable use
Do not scrape, copy or resell our data; interfere with or probe the service; attempt to access accounts, parties or venues that are not yours; upload malware; misrepresent a restaurant; or use SafePlate for anything unlawful. Automated access requires our written permission.
9. Intellectual property
SafePlate, its name, design and software are owned by us and licensed to you for personal, non-commercial use of the app. Restaurant menus, ingredients and photos remain the property of the venues that publish them. If you believe content infringes your rights, contact us with details and we will investigate.
10. Disclaimers and liability
SafePlate is provided "as is" and "as available", without warranty of accuracy, completeness, or uninterrupted service. We do not warrant that any dish is safe for you.
To the fullest extent permitted by law, SafePlate is not liable for indirect, incidental or consequential loss, and our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the preceding twelve months or 100 USD. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
You agree to indemnify SafePlate against claims arising from information you publish, including inaccurate menu or allergen data supplied by a venue you manage.
11. Suspension and termination
You may stop using SafePlate and ask us to delete your account at any time. We may suspend or end access if you break these terms, if a venue publishes unsafe or misleading allergen data, or if we must do so for legal or security reasons. Sections that should survive termination — including reviews licences, disclaimers and liability limits — continue to apply.
12. Governing law, changes, contact
These terms are governed by the laws of the State of Utah, USA, without regard to conflict of law rules, and disputes will be heard in the courts located in Salt Lake County, Utah, unless your local consumer law gives you the right to bring a claim elsewhere.
We may update these terms; we will change the date above and notify you in the app before material changes take effect. Continuing to use SafePlate after that means you accept the update. Questions or notices: legal@safeplate.app.
